{"id":1412,"date":"2019-11-15T11:37:00","date_gmt":"2019-11-15T19:37:00","guid":{"rendered":"http:\/\/165.227.41.74\/?p=1412"},"modified":"2019-12-13T10:57:17","modified_gmt":"2019-12-13T18:57:17","slug":"900000-canadian-bank-records-were-recently-sent-to-the-irs-what-you-need-to-know","status":"publish","type":"post","link":"https:\/\/previous.ca.andersen.com\/fr\/blog\/900000-canadian-bank-records-were-recently-sent-to-the-irs-what-you-need-to-know\/","title":{"rendered":"900,000 Canadian Bank Records Were Recently Sent to the IRS \u2013 What you Need to Know"},"content":{"rendered":"\n<p>A new <a href=\"https:\/\/www.cbc.ca\/news\/politics\/fatca-tax-us-canada-1.5353942?__vfz=medium%3Dsharebar\">CBC article<\/a>\n notes that the Canadian government sent a significant trove of records \nto U.S. tax authority, the Internal Revenue Service in September of 2019\n in accordance with a \u201ccontroversial information-sharing deal\u201d and that \nthe quantity of records involved represents a sharp increase of almost \none third over the previous year.<\/p>\n\n\n\n<p>Canada Revenue Agency\u2019s release of banking information to the IRS is pursuant to the United States\u2019 <em>Foreign Account Tax Compliance Act<\/em>, often referred to as \u201cFATCA\u201d.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is FATCA?<\/h2>\n\n\n\n<p>FATCA became U.S. law in 2010 because of the discovery that foreign \nfinancial institutions such as UBS, Credit Suisse and others were \nhelping U.S. persons evade U.S. tax by not reporting financial accounts \nheld by them outside the United States.&nbsp; Canada agreed to implement \nFATCA for U.S. persons living in Canada, including \u201crecalcitrant account\n holders\u201d to avoid subjecting Canadian financial institutions and their \naccount holders to 30% withholding on U.S. investment income (including \non the gross proceeds from the sale of shares).&nbsp; Recalcitrant account \nholders are individuals who are unwilling to sign under penalties of \nperjury that they are either a U.S. person or not a U.S. person.<\/p>\n\n\n\n<p>The information released allows the IRS to identify U.S. persons who \nhave failed to report investment income and other financial information \nrequired under U.S. tax law.&nbsp; These failures may lead to significant \nU.S. tax penalties, including the inability to renew a U.S. passport and\n criminal sanctions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Will The IRS Do With These Records?<\/h2>\n\n\n\n<p>Using the Canadian banking information provided, the IRS is expected \nto issue notices to U.S. persons in Canada and elsewhere who have failed\n to file U.S. tax returns. Unlike other countries, the U.S. taxes its \ncitizens and residents on their worldwide income regardless where such \nincome is earned or where the individual actually resides. Court \ndecisions in Canada have upheld the terms of Canada\u2019s Intergovernmental \nAgreement with the U.S. to enforce the provisions of FATCA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Minimizing The Risk of Penalties<\/h2>\n\n\n\n<p>U.S. persons (including U.S. citizens, green card holders and \nindividuals meeting the \u201csubstantial presence test\u201d under U.S. tax law) \nmay avoid or minimize penalties by voluntarily filing delinquent U.S. \ntax returns prior to being notified by the IRS.&nbsp; Once contacted by the \nIRS, a tax filing is no longer voluntarily.<\/p>\n\n\n\n<p>The IRS has provided alternative tax filing strategies for delinquent\n U.S. tax filers, including for individuals resident outside the United \nStates.&nbsp; Most U.S. persons resident in Canada will not owe any U.S. tax,\n but without filing the required U.S. tax returns will be exposed to \npenalties for failing to make disclosures of financial accounts outside \nthe U.S. required under U.S. tax law.&nbsp; (Similar disclosures are required\n for certain interests in non-U.S. investments and entities formed \noutside the U.S.).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What If I\u2019m A Canadian Resident With US Tax Obligations or Have Renounced My US Citizenship?<\/h2>\n\n\n\n<p>Canadian residents who are required to comply with U.S. tax filing \nmay have some protection from U.S. tax collection efforts.&nbsp; In other \ncases, the CRA will assist the IRS\u2019 tax collection efforts under the \nCanada-U.S. tax treaty.&nbsp;<\/p>\n\n\n\n<p>Renunciation of U.S. citizenship does not alter U.S. tax obligations \nfrom the period prior to such acts, and may result in more significant \nU.S. tax penalties and tax obligations.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>Failing to file the required U.S. tax returns and make the related \ndisclosures puts U.S. persons at a significant risk.
